Departures (MND/MJD)
Departures are a way to get flexibility from strict rules in the Landscape Manual, sign regulations, or the design of parking and loading facilities, including the required number of parking and loading spaces. They allow changes from the Development Standards to make a development fit better with its surroundings. The Planning Board decides Major Departures, while Minor Departures are decided by the Planning Director.
Major Departures may be requested for standards in Table 27-3614(b)(2), and Minor Departures may be requested for standards in Table 27-3614(b)(1). You may not ask for a Variance if a Major or Minor Departure can be requested for a deviation under these rules. Major Departures may not be granted to change approved Planned Development Basic Plans, but Minor Departures may be granted for minor changes to these plans.
Pre-Application Conference: Required under new Zoning Ordinance for Major Departures and optional for Minor Departures.
Pre-Application Neighborhood Meeting: Required under new Zoning Ordinance for Major Departures and optional for Minor Departures.
